Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ClearCoverCheck (“CCC,” “we,” “us”) websites, applications, and services (the “Services”). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization (“Customer”), you represent that you have authority to bind that organization.

If your organization has a separate written agreement with CCC, that agreement may supersede parts of these Terms.

The Services may include workflows for requesting, collecting, storing, and presenting documents and related data (e.g., insurance cards, identification, intake forms), plus integrations and automations configured by Customers.

Our Privacy Policy describes how we handle information. Our Security page describes safeguards. No system is 100% secure; you agree to use the Services responsibly.

7) Third-Party Services

The Services may integrate with third-party products/services. Third-party terms and privacy policies apply to those services, and CCC is not responsible for third-party systems outside our control.

9) Intellectual Property

The Services, software, and documentation are owned by CCC and its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Services per these Terms and your agreement.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES.

Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the fullest extent permitted.

You agree to indemnify and hold harmless CCC from claims arising out of your misuse of the Services, your violation of these Terms, or your violation of law or third-party rights, to the extent permitted by law and subject to any separate written agreement.

These Terms are governed by the laws of Delaware, excluding conflict of law principles.
